WHEREAS, the Florida Rules of Judicial Administration mandate that the Chief Judge of the Circuit shall develop an administrative plan for the "regulation and use of Courtrooms," Fla.R.Jud.Admin. 2.050(b)(2), and
WHEREAS, the increase in the number of Judges in the Circuit, the increase in the number of cases in the Circuit, considerations of security, and the architectural limitationsinherent in the several Courthouses in the Circuit mandate that each Courtroom be available to the several divisions of the Circuit and County Courts and compatible with the trial of the variety of cases assigned to the several divisions of the Circuit and County Courts and compatible with the trial of the variety of cases assigned to the several divisions of the Circuit and County Courts.
NOW, THEREFORE, it is
ORDERED AND DIRECTED that:
1. The Presiding Judge in each division of the Circuit and County Courts is delegated the responsibility for positioning the microphones, still and television cameras, and for regulating the sources of light in the Courtroom in which he is presiding. The regulation shall accommodate the spirit as wel as the letter of the applicable rules.
2. During the pendency of the proceedings before
him, the Presiding Judge in each division of the Circuit and
County Courts is delegated the responsibility of temporarily
controlling the location and use of audio-visual equipment, including but not limited to overhead projectors, x-ray shadow boxes, videotaping devices, etc., and the responsibility for controlling the visual capability of those seeking to observe the proceedings from the exterior of the Courtroom.
3. Notwithstanding the provisions for the temporary control of the Courtroom by the Presiding Judge as indicated above, no permanent alterations shall be permitted in any Courtroom without the express consent of the Chief Judge.
