IN RE: DAVID ANDREW CAPE
It has become known that DAVID ANDREW CAPE has been harassing court personnel, waiting for court personnel after hours at the Alachua County Courthouse. The Respondent repeatedly attempts to contact and interact with Judge Morris on an ex parte basis and also attempted to interact with Judge Green on an ex parte basis. Although DAVID ANDREW CAPE has pending cases, his presence in the courthouse is not during court events and he is not filing documents with the court, or otherwise conducting official business in the courthouse.
The respondent has pending criminal charges of a violent nature. The Alachua Sheriff's office, Dept of Jail has determined that the respondent is mentally handicapped. DAVID ANDREW CAPE was warned that if behavior of a harassing nature continued, he would charged with trespass and be removed from the courthouse. Mr. Cape's behavior has continued and is disruptive to court procedures and court personnel.
It is necessary that procedures be established for the lawful admission of DAVID ANDREW CAPE to the Alachua County Courthouse, and for appropriate action in the event of his unlawful presence in the Alachua County Courthouse.
It is therefore ORDERED:
1. DAVID ANDREW CAPE is prohibited from entering the Alachua County Courthouse except on lawful business. Should he enter the Alachua County Courthouse, and not be present in the Alachua County Courthouse on lawful business, the warning which is issued against him will be executed and DAVID ANDREW CAPE shall be arrested for violation of the warning against trespass.
2. If DAVID ANDREW CAPE appears in the Alachua County Courthouse on lawful business, that is, to appear at a scheduled court event in response to a notice of hearing or order issued to him, he shall be escorted to the place within the Courthouse where he may discharge his business lawfully, he shall remain under escort for so long as he in the Courthouse discharging his lawful business, and he shall be escorted out of the Courthouse thereafter.
