WHEREAS a "Petition to Determine Incapacity" is filed and a hearing to determine capacity or incapacity is held prior to the appointment of a guardian, and
WHEREAS, a caption including the words "IN RE GUARDIANSHIP OF" on a Petition to determine incapacity may cause confusion and may in certain cases be incorrectly interpreted to mean a guardianship has been established prior to the hearing on capacity,
IT IS ORDERED that no "Petition to Determine Incapacity shall be filed using a caption including the words "IN RE THE GUARDIANSHIP OF." Petitions to determine incapacity may be captioned "IN RE THE DETERMINATION OF CAPACITY OF."
