THE EIGHTH JUDICIAL CIRCUIT OF FLORIDA
ADMINISTRATIVE ORDER NO. 6.400
GUARDIAN BONDS IN VETERAN'S GUARDIANSHIPS

Whereas, section 744.619, Florida Statutes, provides for the court to approve bonds for guardians appointed in veteran's guardianship cases. See § 744.602, Fla. Stat. Section 744.619, Florida Statutes, further provides that the bond shall be in the form, and shall be conditioned, as bonds required of guardians appointed under the general guardianship laws of this state.

Whereas, section 744.351, Florida Statutes, which is part of the general guardianship portion of the code, provides that every person appointed a guardian of the property of a ward in this state shall file a bond with surety as prescribed in section 45.011, Florida Statutes, to be approved by the clerk.

Whereas, in order to fully comply with the requirements of section 744.619, Florida Statutes, the Court must determine whether the bond is in the form that would be approved by the Clerk of Court as required by section 744.351, Florida Statutes. It is therefore

ORDERED that the Clerk of Court is directed to screen all bonds posted by guardians appointed in veteran administration guardianships to determine whether the bond is one that the clerk would sign in a general guardianship case and report to the court that the bond is or is not ready for approval by the court.

ORDERED on September 5, 2002.
