The following Administrative Order is entered to facilitate the Clerks of Court of the Eighth Judicial Circuit in crediting child support received by H.R.S. pursuant to the various intercept programs:
1. Designed agents of H.R.S. are hereby recognized as parties with standing before the Courts of the Eighth Judicial Circuit for the purpose of petitioning or certifying that H.R.S. has received monies from the Treasurer of the United States of America, pursuant to the Internal Revenue Code of 1954, Section 6305; Unemployment Compensation funds; State of Florida Lottery winnings; Worker's Compensation funds, if applicable; and all other funds which have been received by H.R.S. through various child support intercept programs presently existing or hereinafter implemented by the Federal or State of Florida authorities.
2. Upon certification by said H.R.S. agents that such funds have been received by H.R.S. to be applied toward either the arrearage or current child support payments due pursuant to previous orders of the Court, the Clerks of the Eighth Judicial Circuit are authorized and directed to credit the obligor's (responsible parent or other party) child support account in the amount of said funds certified to the Clerk of Court by H.R.S.
without further Order of this Court.
Certification shall be by H.R.S. delivery of an original written affidavit (see attached Certificate for Child Support Credit) to the appropriate Central Governmental Depository for subsequent filing in the appropriate court file. The Certificate of Service on the Certificate for Child Support Credit shall include a copy of said Certificate for Child Support Credit being sent to the child support obligor.
3. When said credit is allowed the responsible payor against his child support account pursuant to the certificate filed by H.R.S., it shall be without prejudice to any interested party to appropriately petition this Court for a review of the propriety of said credit.
