Serious Habitual Offender Comprehensive Action Program

    Whereas, the Eighth Judicial Circuit, together with local law enforcement of Alachua County is concerned about the number of habitual juvenile offenders in Alachua County, and
    Whereas, an effective and responsive juvenile justice system must take decisive measures to protect the community from juvenile crime and promote preventative means to assist at-risk juveniles, and
    Whereas, the Court, the Department of Juvenile Justice, the State Attorney's Office, the Public Defender's Office, the School Board of Alachua County the Sheriff, and other interested parties have joined together to form a Serious Habitual Offender Comprehensive Action Program ("SHOCAP") for Alachua County and have established criteria for designating juveniles as serious habitual offenders, and
    Whereas, the SHOCAP partners agree to participation in long range cooperation, with special emphasis placed on juveniles who are designated serious habitual offenders, by sharing information, resources and training  efforts in order to reduce juvenile crime, and
    Whereas, any juvenile designated as a serious habitual offender, pursuant to the criteria established by the Alachua County SHOCAP interagency committee, placed under a SHOCAP order of supervision, or any juvenile committed to the Department of Juvenile Justice, may be taken into custody by any law enforcement officer, if  a petition or motion alleging a violation of SHOCAP supervision has been filed, and the Court has issued an Order to take into custody upon finding that there is probable cause to believe that the juvenile is in violation of his or her SHOCAP order of supervision, because the juvenile has committed a new criminal offense, or has violated any condition of the SHOCAP order of supervision. An affidavit/petition for violation of SHOCAP supervision and an Order to take into custody are included as attachments "A" and "B" for use in Alachua County.
    It is therefore,

    ORDERED as follows:

        A. If a member of the SHOCAP unit has reason to believe that there is probable cause that a juvenile is in violation of his or her SHOCAP supervision, a sworn affidavit must be filed with the Court alleging facts which under existing law or supervisory conditions are determined to authorize taking into custody a previously designated SHOCAP offender.
        B. Upon review of the sworn affidavit, the Court may issue an Order to take said juvenile into custody.
        C. If probable cause exists for taking a juvenile into custody, the juvenile is under a SHOCAP order of supervision or committed to the Department of Juvenile Justice, and the Court has issued an Order to take into custody, the juvenile shall be immediately delivered to the Alachua Regional Detention Center to be held pending a detention hearing or further Order of this Court.
