Inasmuch as §39.044 (2) (g) Fla. Stats. (1997) requires that any
juvenile that meets detention criteria and is detained pursuant to §985.215
shall be given a hearing within 24 hours after being taken into custody,
it is necessary for the Chief Judge of the Eighth Judicial Circuit to insure
appropriate judicial coverage for such hearings for the orderly administration
of justice. It is, therefore,
ORDERED that
The presiding judge for Family Law Division "H" shall conduct
any detention hearings as are necessary in Alachua County on Mondays and
Fridays excluding legal holidays.The presiding judge for Family Law Division
juvenile dependency cases shall conduct any detention hearings as are necessary
in Alachua County on Tuesdays excluding legal holidays and shall provide
back up coverage on Mondays and Fridays excluding legal holidays. The presiding
judge for Family Law Division juvenile delinquency cases shall conduct any
detention hearings as are necessary in Alachua County on Wednesdays and
Thursdays excluding legal holidays. In the event of absence or inability
to conduct the hearings, the assigned judge will, with the assistance of
the deputy court administrator, arrange for the hearings to be conducted
by another circuit judge.
Circuit and county court judges conducting first appearance on weekends
and legal holidays will likewise conduct detention hearings in delinquency
cases in accordance with §985.215 Fla. Stats. (1997) and Fla. R. Juv.
P. 8.010; provided that detention hearings shall be conducted separately
from first appearance hearings.
County court judges of Alachua County are hereby designated as judges of
the circuit court for the purpose of conducting juvenile detention hearings
on weekdays, weekends and holidays.
This order supersedes and rescinds Administrative Order No. 5.240(A).
