WHEREAS there exists a serious problem of overcrowding in the Alachua County Department of Corrections and because prisoners arrested and held for other jurisdictions, not including prisoners of the United States or sister States, are not being timely removed to the appropriate jurisdiction this Court now has determined a need for emergency procedures to permit release or removal of such prisoners.
It is therefore,
ORDERED AND ADJUDGED that the Director of the Alachua County Department of Corrections, with the assistance of Court Services and the Sheriff of Alachua County, shall return any prisoner held seventy-two (72) hours after the date of notification to the jurisdiction issuing the warrant, to a subsequent appearance before the first appearance magistrate for reconsideration of conditions of release from detention.
