ADMINISTRATIVE ORDER NO. 1.770 (B) [New Order No. 4.770(B)]

(Amending No. 1.770 (A) dated September 16, 1987)

AMENDED ADMINISTRATIVE ORDER REGARDING NCIC/FCIC RECORDS

WHEREAS it is necessary to the efficient administration of the Criminal Divisions of the Alachua County Courts that in so far as is possible the routine handling of pleas and sentencings in criminal cases be expedited, and whereas considerations for sentencing based on the prior record of the defendant must be taken into account not only by the Court but also by the State and by defense counsel at the earliest practical date, and whereas such information is routinely available to the Court through the Department of Court Services as early as at arrest but generally has not been provided to the State until after First Appearances or to defense counsel until a formal discovery demand is filed under the applicable rules of procedures, even though the ultimate disclosure thereof will clearly be required at some point under Fla. Rule of Crim. Pro. 3.220(a)(5), and whereas, the early providing of such will expedite the handling of cases, it is

ORDERED AND ADJUDGED

That the Department of Court Services shall obtain an NCIC/FCIC records check on each defendant arrested in Alachua County as soon thereafter as practical and shall provide two copies thereof to the Office of the State Attorney at First Appearances. Pursuant to Fla. Rule of Crim. Pro. 3.220(a)(5), the Office of the State Attorney shall provide one copy thereof to the Office of the Public Defender when that office is appointed to represent the defendant.
