ADMINISTRATIVE ORDER 1.390

[New Order No. 2.390]

PROCEDURES TO BE FOLLOWED BY THE CLERK RELATING TO COUNTY COURT TO CIRCUIT COURT APPEALS

1. The Clerk, upon the proper filing of a Notice of Appeal in the Circuit Court for the exercise of the appellate jurisdiction of the Circuit Court, shall furnish the Circuit Judge presiding over the division to which such case is assigned with a tentative schedule of dates for accomplishment in each such case of the requirements under the Florida Rules of Appellate Procedure.

2. The Clerk shall notify each such Circuit Judge as to the appeals pending in his division on the first of each month and shall advise each such Circuit Judge on each of the critical dates involved in such schedule as to the failure of performance as to each such date.

3. After all briefs have been filed or after the passage of time within which such briefs are permitted to be filed, the Clerk shall immediately transmit the file to the Circuit Judge to whom the case is assigned. Such presiding judge may then set oral argument on the case on his own motion or proceed to consider and dispose of the case as the judge then deems proper without waiting for counsel to set argument on the court calendar.

4. The purpose sought to be accomplished by this order is to assist the presiding circuit judge of each division in seeing that all appeals pending before the Circuit Court are properly and promptly prosecuted, considered and disposed of with the dispatch contemplated by the Florida Rules of Appellate Procedure.
