                                    ORDER DIRECTING PARTIES TO MEDIATION

 

            THIS ACTION came before the Court for review.  The Court finds that this case is a county dispute, and that the parties have not participated in mediation as required under Administrative Order No. 3.1100(D).  Therefore, 

            IT IS ADJUDGED that:

            1.         The parties are referred to mediation pursuant to Administrative Order No. 3.1100(D) and Florida Rules of Civil Procedure Rules 1.750 and 1.720(f). 

            2.         Within ten (10) days from the date of this order, the parties are required to schedule a mediation appointment in an attempt to resolve all disputed matters.  The parties may either schedule a mediation with a private mediator, or they may schedule a mediation with a program mediator through the Eighth Judicial Circuit County Mediation Program office at (352) 491-4645.    If the parties fail to select a mediator within ten (10) days from the date of this order they shall contact the County Mediation Program, and the ADR Director will appoint a program mediator from the circuit’s rotation list or county mediators.  

            3.         All Parties who utilize a  program mediator,  unless determined to be indigent,  shall be assessed mediation costs pursuant to Fla. Statute 44.108  in the amount of forty dollars per person per session.   ALL FEES MUST BE PAID AT THE CLERK OF COURT’S OFFICE PRIOR TO THE START OF THE MEDIATION.


 

            4.         Unless otherwise excepted by statute, rule, or Court order, the parties shall begin mediation for all disputed matters within forty-five (45) days of the date on which this order is entered.

            5.         Unless otherwise excused by the Court, all mediation shall be concluded within forty-five (45) days of the first mediation conference.

            6.         All discussions, representations and statements made at the mediation conference are confidential pursuant to Fla. Statute 44.102.

            7.         Sanctions may be imposed on the parties for refusal to comply with the mediation process according to Administrative Order No. 3.1100(D).
