ORDER REFERRING CASE TO MEDIATION
REQUIRING DESIGNATION OF PRIVATE MEDIATOR
If an impasse occurs at mediation and a Motion or Notice to Set Trial was filed in this case prior to the mediation, counsel shall file a Second Notice that action is at issue or Motion to Set Jury Trial and forward a courtesy copy to the Court stating an impasse at mediation and case management will be scheduled.
The court finds that there are disputed issues which require mediation, it is therefore
ADJUDGED that:
1. This cause is hereby referred to mediation.
2. The parties shall notify the Court of the mediator designated. If the parties fail to select the mediator, the Court will appoint one from the rotation list for the Eighth Circuit.
3. The first mediation conference shall take place as coordinated by counsel and mediation shall be concluded within 45 days of the first mediation conference.
4. The cost of the mediation shall be borne by the parties equally unless otherwise agreed to in writing. Either party may object to mediation on grounds of financial hardship or any ground set forth in Rule 1.700(2)(b).
5. All discussions, representations and statements made at the Mediation Conference are confidential.
6. Sanctions may be imposed on the parties for refusal to comply with the mediation process.
7. The mediator will file a report with the Clerk of Court stating whether the parties reached agreement, partial agreement or no agreement.
